Rebate Requirements
Load Control Agreement for Hybrid Geothermal Units
This is an agreement made & entered into by Midland Power Cooperative and the member receiving this rebate. The terms and conditions are as follows:
  1. Cooperative provides electric utility service at retail to its Members, and (b) provides rebates for geothermal heat pumps to its Members who have a gas as an automatic heat backup source and sign this Load Control Agreement.  Cooperative agrees to provide Member a rebate in addition to other energy efficiency and electric value rebates.
  2. Member agrees to: (a) install a geothermal heat pump and provide a gas, automatic heat backup; b) install the equipment at Member's expense at Member's premises and (c) purchase from Cooperative and pay for all electric energy required to operate the equipment, (d) this Agreement will allow this Cooperative to control the heat pump in the future.
  3. Member agrees to: (a) allow Cooperative access to verify that the equipment has been installed and to install load control equipment in accordance with the requirements of this Agreement; (b) authorize Cooperative, at Cooperative's expense, to install, operate, maintain, and replace as necessary, control equipment on facilities that will allow Cooperative to interrupt electric service to the heat pump; and (c) authorize Cooperative to interrupt electric service to the heat pump at specified times.
  4. Member agrees that neither the Cooperative nor its wholesale power supplier shall be liable for any loss, costs, or damages caused by or resulting from Member's purchase, installation, operation, or use of the equipment, or Cooperative's interruption of electric service as authorized by this Agreement.
  5. The Cooperative shall have the right to cancel this Agreement in the event Member fails to install or maintain the heat pump, or tampers with, or modifies the load control equipment. Member may cancel this Agreement by providing Cooperative not less than thirty (30) days advance written notice of cancellation. In the event of cancellation by Cooperative or Member, Member shall pay Cooperative the discounted value for load control incentive and, in the event the load control equipment has been installed, shall allow the Cooperative to remove the load control equipment and shall pay for the Cooperative's cost of installing and removing said equipment.
This Agreement is effective as of the date and year as first above written, and shall remain in effect, including sale of property where the heat pump is located to new owner, for the useful service life of the heat pump, unless sooner cancelled pursuant to paragraph 5 of this Agreement.
