Please make and keep a copy of this application for your records.

 

Submission of this application verifies that the applicant has provided accurate information to enroll in the Wi-Fi water heater pilot program (the “Pilot Program”). By signing this application, the applicant further agrees and certifies as follows:

 

(1)

The applicant is a residential member of Hendricks County Rural Electric Membership Corporation d/b/a Hendricks Power Cooperative

(“HPC”), and the applicant receives electric service from HPC to the address listed on this application.

 

(2)

Neither Wabash Valley Power Association, Inc. d/b/a Wabash Valley Power Alliance (“Wabash Valley”) nor HPC assume any

responsibility or liability arising out of or relating to the applicant’s participation in the Pilot Program.

 

(3)

As part of the enrollment in the Pilot Program, the applicant will download the Armada Power application on the applicant’s mobile

device and will agree to the Armada Power Controller Software License Agreement contained therein, which includes, without limitation:

 

(a)

Armada Power software for use with the device installed as part of the Pilot Program may collect and transmit data to Armada. The applicant consents to Armada’s collection, retention and use of any data collected by the Armada Power software and the device. Armada Power retains the right to use, sell, disclose, transfer or rent all data and deliverables, including user data, only in aggregate form, not including individually identifiable information. The applicant acknowledges and agrees that the data may include limited amounts of personal data, such as the applicant’s name, address, appliance information, utility account number, appliance electric consumption data, appliance condition and status, Wi-Fi or cellular network information and local IP address. Armada Power will use commercially reasonable safeguards to protect any personal data.

 

(b)

The applicant acknowledges that the device installed as part of the Pilot Program and the Armada Power software transmit data over a Wi-Fi or cellular network, and the applicant is responsible for any charges relating to such data transmission unless otherwise agreed in writing between the applicant and Armada Power.

(4)

The data collected by Armada Power may be provided to Wabash Valley and/or HPC for the purpose of evaluating the success of the Pilot Program and determining the reduction in demand of energy resources associated with the Pilot Program.

 

(5)

Armada Power and/or Wabash Valley have all right and authority to control the device installed on the applicant’s premises as part of

the Pilot Program and may test the device as necessary during the term of the Pilot Program.

 

(6)

The applicant will schedule an appointment with HPC or its designated contractor within a reasonable time after submission of this application to have a proper device installed at the applicant’s premises in order to participate in the Pilot Program. The applicant will

contact HPC regarding any ongoing maintenance issues with the device.
